Terms and Conditions of Sale

1. Scope
These terms and conditions of sale govern and regulate the sale of products marketed by John Arena Company Ltd. through its Web site arenabiscotti.com.

All contracts concluded for the purchase of products through the site “arenabiscotti.com”, following the procedures set out therein between the supplier and customers, will be governed by these Terms and Conditions of Sale, which form an integral and essential part of the same.

2. Nature of the relationship between buyer and supplier
By ordering products from arenabiscotti.com or accepting delivery of the products described in the invoice, the buyer agrees to be bound by and accept these terms and conditions. The supplier reserves the right to change these terms and conditions without prior written notice at any time, at its sole discretion. Each contract will be subject to the version of the terms and conditions applicable at the time of its conclusion.

3. Protection of personal data
Under Decree Law n. 196/03 relating to the protection of persons and other subjects regarding the processing of personal data, the purchaser is informed that the personal data provided with the purchase order will be processed, in compliance with those laws, only in fulfillment of the obligations arising from the purchase of goods / services. The consent to the data supplied by the purchaser for purposes connected with the purchase is required and is therefore given automatically by sending a purchase order.

4. Electronic Communications
By setting up the order at arenabiscotti.com, you agree to receive e-mail communications from us relating to the status of your order. On the other hand, If you communicate with us electronically via the contact page, also agree to receive e-mails from our customer service team.

All content is protected by copyright of arenabiscotti.com. Individual pages or sections can be downloaded and printed, provided that neither copyright notices nor other legally protected symbols are removed. In any case, The vendor remains owner of all proprietary rights related. This Web site may be reproduced, in whole or in part, transferred electronically or through conventional means, modified, the subject of links, or used for public or commercial purposes, without the prior written consent of the supplier.

6. Title and risk of loss
Products purchased from arenabiscotti.com conform to a shipment contract. In accordance with the contract, the risk of loss and damage will be sent to you upon delivery.

7. Product Descriptions
The vendor and its partners want to ensure that product descriptions or other content arenabiscotti.com be as precise as possible. However, the supplier does not guarantee that these product descriptions and other content are error-free. If the product offered meets the description is not at arenabiscotti.com, the only remedy is to return to the user according to the same procedure as outlined in 11.

11. Right of withdrawal
Pursuant to Article 3 of Legislative Decree. 185/99, on the protection of consumers in respect of distance contracts, l’acquirente, that for any reason not satisfied with the purchase made, has the right to terminate the contract of sale, without penalty and without specifying the reason, within 3 working days following the date of receipt of goods.

The withdrawal must be exercised by sending the above term provided under penalty of forfeiture, written notice by email to ordini@arenabiscotti.com explicit that the intention to withdraw from the contract.

If the buyer exercises his right of withdrawal, shall also provide at his own expense to return the goods intact and unused (in its original packaging)

The refund will be made no later than the end of 3 working days with prepaid insured package at the headquarters of the supplier or: JOHN ARENA LTD SS121 Km.9 – Contrada Vazzano – 95040 Motta S. Anastasia (CT) Italy.

NB. Unless otherwise agreed, will not be withdrawn under any circumstances parcels cash it’ assigned to port.

If the right of withdrawal has been exercised in accordance with these instructions, the supplier shall refund the sums paid by the purchaser for the purchase of goods (with the exception of costs relating to the return of goods, remaining to be paid by the buyer and the cases specified below), within 30 days.

12. Acceptance and Returns
The products will be deemed accepted by the purchaser at the time of their delivery. Except in the case where the purchaser exercises the right of withdrawal under Article. 11 before, such acceptance is presumed until the buyer informs the supplier, as soon as possible and in any event no later than 3 (three) working days of receipt of goods, that the product has been delivered in terms of inoperability or otherwise defective.

Following this last communication, the supplier will, his choice, to replace defective products or refund the amount paid by the buyer for their purchase.

The supplier has the right to control the products at the time of their return and to charge the purchaser all costs incurred by the supplier in case of false declaration of inoperability or defective products returned.

Any refund must be made within 3 working days from the date of delivery to the user.

13. Canceling an order
Because almost instantaneous processing of orders from the company, the cancellation of an order can not be. If the product is no longer required, follow the return procedure outlined in section 11.

14. Jurisdiction and applicable law
Any dispute regarding the application, execution, and breach of contract of sale concluded “on line” via the website is subject to Italian jurisdiction arenabiscotti.com. These general conditions are governed by Italian law and are reported, although not expressly referred to therein, Legislative Decree. n. 50/92 and Legislatnve Decree. n. 185/99.

15. Competent forum
Any dispute arising in relation to contracts governed by these Terms or that it was still connected to them, will be referred to the Court of Catania.

Important Note: The present revision of the General Conditions, namely, that in effect at the time of signing by the customer of their order, govern the order; The customer is therefore requested to print and keep a copy of this Terms future reference. Rev. 19 November 2007.

Pursuant to the effects of Articles. 1341 and 1342 Code of Civil, Customer declares to have carefully read and understood and agree to the Terms and Conditions of sale listed above.
